José Vicente Morote analyses the regulation of administrative titles in an ICAV conference

José Vicente highlights the positive overall balance of the impact of the Bolkestein Directive on the simplification of formalities and the removal of barriers to the performance of activities

The partner responsible for Public and Regulatory Law at Andersen Tax & Legal, José Vicente Morote, has participated as a speaker at the Conference "Licences and other enabling titles", organised by the Valencia Bar Association (ICAV) on 30 October 2018.

José Vicente Morote spoke at the opening session of the Conference, with a paper entitled "The paradigm shift in the regulation of administrative titles enabling activities. From the Bolkestein Directive to the present day", in which he carried out an analysis of the evolution of the regulatory and factual situation that has been taking place since Directive 2006/123/EC of the European Parliament and of the Council of 12 December 2006 on services in the internal market was approved.

The head of Public and Regulatory Law at Andersen Tax & Legal highlighted the positive overall balance of the impact of the Bolkestein Directive on the simplification of procedures and the elimination of barriers to access to the performance of activities and noted that, nevertheless, "to this day there are still significant problems to be resolved". At this point, he analyzed specific cases such as those relating to the limitation of the activity of leasing vehicles with driver - the so-called VTC licenses - and the limitation that is currently being made in respect of buildings intended for leasing for tourist use.
